Terms

Welcome to Carisma! Carisma is a software platform utilized by automotive dealerships to communicate with their customers. We do not own or operate the dealerships; we are strictly a software technology provider that powers their communications with you regarding your vehicle.

These Texting Terms and Conditions (“Terms”) govern your receipt of messages sent via the Carisma Texting Platform. By opting in to receive SMS/MMS text messages from a participating dealership, or by engaging in transactions with them, you agree to these Terms.

We have designed the Carisma platform to facilitate compliance with the Telephone Consumer Protection Act (TCPA), the California Consumer Privacy Act (CCPA), and CTIA guidelines.

Dealer Responsibility for Marketing Compliance
As the software provider, Carisma supplies the tools to send messages, manage opt-outs, and enforce "quiet hours." However, the participating dealership is solely responsible for the content of the messages and for ensuring that all marketing campaigns, promotional texts, and customer communications strictly adhere to all applicable local, state, and federal laws, including TCPA, CCPA, and CTIA guidelines.
Carisma is not liable for the marketing practices, message content, or compliance failures of the individual dealerships using our software.

How You Are Opted In

You may be opted in to receive text messages powered by Carisma through the following methods:

  • Transactional Consent: By purchasing a vehicle, ordering parts, or authorizing repairs with a dealership that utilizes Carisma software, you consent to be contacted regarding those transactions and related services.
  • Direct Opt-In: Entering your phone number and checking a consent box on a dealership's website or digital form.
  • In-Person Consent: Providing verbal or written consent to staff at a participating dealership or service center.
  • Keyword Opt-In: Texting a keyword (e.g., "JOIN" or "START") to a designated dealership phone number or short code.

By opting in or engaging in a transaction, you consent to receive automated promotional and informational text messages sent via the Carisma platform on behalf of the dealership. Consent to receive promotional messages is not a condition of purchasing any goods or services.

Message Frequency and Types

Once opted in, you may receive the following types of messages on behalf of the dealership:

  • Informational/Transactional: Appointment reminders, service completion updates, parts order statuses, billing notices, and vehicle recall alerts.
  • Promotional/Marketing: Exclusive service discounts, seasonal maintenance specials, and event invitations from the dealership.

Message frequency varies based on your interactions with the dealership and the services you request.

How to Opt-Out
You can stop receiving text messages sent via Carisma at any time. To opt-out, simply reply "STOP", "QUIT", "CANCEL", "END", or "UNSUBSCRIBE" to any text message you receive.

Upon receiving your opt-out request, our system will send one final message confirming that you have been unsubscribed from that dealership's communications. After that, you will no longer receive text messages from them via our platform, unless you choose to opt back in.

Help, Support, and Security Concerns

If you need assistance or have questions about the text messages you are receiving, reply "HELP" to any text message, or contact the dealership directly.

For technical support regarding the messaging platform itself, or to report any security or privacy concerns, please contact Carisma directly at Hello@CarismaCar.com.

Message and Data Rates

Message and data rates may apply for any messages sent to you and to us from you. If you have questions about your text plan or data plan, please contact your wireless service provider.

Our Strict Privacy Promise: We Do Not Sell Your Data

Your privacy is our priority. Carisma strictly prohibits the selling, sharing, or distributing of your personal information, including your mobile phone number, to any third parties for their marketing purposes.
As a software provider, Carisma only processes your phone number and consent information to facilitate communications between you and the dealership you do business with. We adhere to all requirements of the California Consumer Privacy Act (CCPA) and California's "Shine the Light" law to ensure your data is protected.

California Consumer Privacy Rights

If you are a resident of California, you have specific rights regarding your personal information under the CCPA:

  • Right to Know: You can request details about the personal information collected and how it is used.
  • Right to Delete: You can request the deletion of your personal information from our systems. (Note: Replying "STOP" opts you out of texts, but a formal deletion request removes your data entirely, subject to certain legal exceptions).
  • Right to Non-Discrimination: You will not be discriminated against for exercising your privacy rights.

Quiet Hours (California Compliance)

In compliance with California regulations and to respect your time, the Carisma platform restricts the sending of automated promotional text messages to the hours of 9:00 AM to 8:00 PM (your local time). Transactional messages regarding active service appointments, parts orders, or vehicle purchases may be sent outside these hours if necessary for your immediate awareness.

Changes to These Terms

Carisma reserves the right to modify these Texting Terms and Conditions at any time. Any changes will be effective immediately upon posting. Your continued receipt of messages via the Carisma Texting Platform constitutes your acceptance of any revised Terms.
